Due-on-sale
A land trust does not prevent a lender from enforcing a due-on-sale clause in a subject-to transaction. The exception at 12 U.S.C. § 1701j-3(d)(8) requires that the borrower is and remains a beneficiary and that the transfer does not relate to a transfer of rights of occupancy. A subject-to purchase fails both conditions.

Unauthorized practice of law
States differ substantially in whether a non-attorney may prepare conveyancing documents. Where a state requires an attorney to prepare or supervise these documents, supervising counsel admitted in that state is engaged and the cost appears as a line item on the quote.
